Suppose that jack, hal, and sophia enter into an agreement in regards to the sale of the restaurant. the contract includes the non-competition agreement. a few months later, jack decides that he will sell the frozen food in violation of non-competition agreement, unless if hal and sophia agree to pay him an extra $100,000. hal and sophia agree, since they do not want to fight. six months later, however, they still have not paid and jack sues. what is the result?

    In this case, both will have to go through a civil court in order to settle the issue. If Hal and Sophia decide to settle amicably, then Jack may drop the charges. However, a most likely scenario would be that Hal and Sophia would use the violation of the non-competition agreement as a defense for not paying Jack with Jack fighting back than an agreement was made despite the non-competition agreement. In the end, both parties will end up having to pay a hefty sum.
