A nanny cared for four kids every day from 7:30 am through 5:00 pm. The nanny drove the 5-year-old son to half-day kindergarten each day at 11:00 am. One day the nanny was distracted by the kids squabbling in the back seat, and struck another vehicle. Could the driver of the other vehicle sue the kids' parents?

    The driver of the other vehicle could sue the kids' parents under vicarious liability. In this the nanny is employed by the kids' parents and he committed a mistake while being in the term of employment so kids' parents are held liable. A person is held responsible for the damage caused by someone else.
