Lance, a hacker, stole 15,000 credit card numbers and sold them on the black market, marketing millions. Police caught Lance, and two legal actions followed, one civil and one criminal. a. Who will be responsible for bring the civil case? b. What will be the outcome if the jury believes that Lance was responsible for identity thefts? c. Who will be responsible for bringing the criminal case? d. What will be the outcome if the jury believes that Lance stole the numbers?

    Explanation:

    a. Civil Cases are cases where private citizens of a nation sue other private citizens on the basis of a breach of trust or contract, actions that caused harm or other general grievances.

    The Civil Case in the matter will therefore be brought by the private citizens who's credit card numbers, Lance stole.

    b. The penalty for a successful prosecution of Civil Cases is usually monetary compensation to ease the suffering of the aggrieved citizen so in this case Lance will probably be ordered to make financial restitution.

    c. Criminal cases are brought by the states against entities who acted against the law. Lance acted against the law in stealing and selling Credit Card numbers which could be used in identity theft. He therefore broke the law and so will be liable to criminal cases which will be brought against him by State agents/prosecutors.

    d. If the Jury find that Lance stole the numbers this would indeed mean that he broke the law. The usual punishment for breaking the law especially in a crime is this is Imprisonment so Lance will most likely be sent to jail to serve some time for his actions.
