Is it possible for smart phones to be hacked to cyber bully private U. S. citizens by hackers and government employees, and how would that be viewed by the constitution?

Since this would be considered free speech, the U. However, obviously in the modern US, hacking without permission is a crime, and sentences can vary from six months to even a few years depending on the significance of the hack.
