    The eligibility of an individual to vote is included in the constitution and regulated at the state level. The constitution establishes that the right to suffrage can not be denied for reasons of ethnicity, sex or age for citizens over 18 years of age. Beyond these basic qualifications, the statutes of state legislation have the responsibility to regulate voter eligibility. States prohibit voting criminals who are serving a sentence for some period of time or indefinitely. The number of US adults who are prevented from voting for being convicted of serious crimes is estimated at 5.3 million.

    Registering to vote is the responsibility of US citizens since voters are not automatically registered when they turn 18. All states, with the exception of North Dakota, require that citizens wishing to vote be registered. Traditionally, voters had to register at state offices, but in the mid-1990s, the federal government made an effort to facilitate this procedure. The National Voter Registration Act of 1993 forced state governments to make the voter registration process easier by providing uniform registration services through the registration centers for driver's licenses, schools, libraries and registration through the mail. Idaho, Minnesota, New Hampshire, Wisconsin, Wyoming and North Dakota are exempt because in these states (except North Dakota, where registration is not required) the registration was adopted on the same day, allowing voters to register for vote on election day.

    Voters who exercise their right in voting centers usually do so through an Optical Scanning Electoral System or DRE Electoral Machines. The election of the electoral machines is done by the local electoral jurisdiction of each state.
