The concept of Judicial Review came with the ruling of the case Marbury v. Madison by the US Supreme Court. Judicial Review is the process that consists of judges examining if the laws or acts are or not compatible with the Constitution.

Although the Judicial Review is not explicitly on the Constitution, it is one of the most important parts of the system of Checks and Balances. One passage of the Marbury v. Madison decision says: "It is emphatically the duty of the Judicial Department to say what the law is. Those who apply the rule to particular cases must, of necessity, expound and interpret the rule. If two laws conflict with each other, the Court must decide on the operation of each."
