    Justice Goldberg uses the Ninth amendment to state that people have Unnumerated rights as well as those stated in the Constitution. The Court used this amendment to argue that marriage was part of the right to privacy.

    Explanation; Ninth amendment was a part of the Bill of Rights and established that there are many rights that people have but that are not enumerated in the constitution verbally. According to the ninth amendment, the enumeration in the Constitution of certain rights should not be construed to deny or disparage others retained by the people. The Ninth Amendment reveal that the Framers of the Constitution believed that there are additional fundamental rights, protected from government infringement, which exist alongside those fundamental rights specifically mentioned in the first eight constitutional amendments.
