Fred Korematsu argued that internment was unconstitutional mainly because internees did not receive due process.

Japanese-Americans were forced from their homes and relocated to interment camps in compliance to President Franklin D. Roosevelt's Executive Order 9066.

EO 9066 states that all West Coast residents of Japanese ancestry be designated as "enemy aliens" whether they are U. S. citizens or not.

Fred Korematsu argued that internment is a violation of his constitutional rights and is a blatant form of racial discrimination.
