    The penalty varies from state to state. Some states give you the right to refuse a test. If you are in a state that doesn't allow you to refuse a blood alcohol test you will almost always receive a suspended license. The length of the suspension may be anywhere from three months to a year. Any charges of this matter will be separate from the DUI you will receive. You may also receive a fine that is $1,000 or more if it's your first offense. If you are pulled over make sure to ask for your chemical test rights and the officer will inform you of your rights and any penalties that you may receive.
