How is agency law part contract law and part tort law and how do these two combine to shape the working relationship?

    The purpose of the civil liability system is to compensate for the damage caused regardless of whether the contractual or extracontractual liability, both coexisting in the legal system and it is sometimes complicated to discern the boundary between one and the other. There is contractual liability if a double requirement is met: that between the parties there is a contract or a contractual relationship and that the damages are due to non-compliance or defective fulfillment of what is strictly the subject of the contract. On the other hand, liability is extracontractual when with totalindependence of obligations of any other type that exist between the parties, the damage is produced by violation of general duties of conduct emanating from, or the general rule.
