It all started when Allan Bakke wanted to enter medical university but was rejected twice. Although his grades were higher than those of any of his classmates, which led him to the conclusion that he was rejected for his race.

This prompted the Supreme Court to rule that what universities did by denying the right of admission to certain students was unconstitutional only in some cases, but they approved the use of an affirmative action where they reserved 16 of 100 places for minorities to perform the exam to enter the University of Medicine, although race could still be considered as a factor to be taken into account at the time of admission only in the case that other factors are taken into account too.
