South Africa’s Constitution contains a right to equality. This right grants everyone the entitlement to be treated equally, and it imposes an obligation on everyone to treat people equally. With regard to people with HIV this would mean that no one may be discriminated against for being HIV positive, and everyone that is HIV positive may demand to be treated equally like those who are not HIV positive.
