Which powers are easier to challenge ... expressed or implied ... and why? (Hint:

Imagine someone going to court and arguing that the government really doesn't have

those powers and is just abusing its authority ... which type of power would be most

vulnerable to this type of criticism?)

    implied power ... An example of implied power is when Congress passes legislation on national health care based on the power granted to Congress by the Constitution to collect taxes and provide for the common defense and general welfare of the United States.
